1. About these terms
These terms are an agreement between you and [registered company name], a company registered in England and Wales (company number [company number]) whose registered office is at [registered address] ("Video Audio Creator", "we", "us"). They apply when you use the website at videoaudiocreator.com, join the waitlist, or use the Video Audio Creator service once it opens.
By joining the waitlist or using Video Audio Creator, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Video Audio Creator.
2. The waitlist
Video Audio Creator is not open yet. Joining the waitlist is free and doesn't commit you to anything. We'll email you when the service opens.
We can't promise an opening date. The features, plans and prices shown on the website are what we plan to offer, and they may change before we open. The terms and prices that apply will be the ones shown when you sign up or subscribe.
3. Who can use the service
You must be 18 or over. You can use Video Audio Creator for yourself or on behalf of a business. If you use it for a business, you confirm you're allowed to accept these terms for that business.
4. Your account
Give accurate details when you sign up and keep your email address up to date. Keep your password secret. You're responsible for activity on your account, so tell us straight away at hello@videoaudiocreator.com if you think someone else has used it.
5. Plans, payments and cancelling
- Free: 3 shorts to try, with a watermark, at 720p. Free-plan media is for personal, non-commercial use.
- Creator (£9.99 a month) and Studio (£24.99 a month): the monthly allowance and features described on our pricing page. Prices include VAT.
- Monthly allowance: your allowance of shorts and voiceovers resets each billing month. [Decide: unused allowance does / does not carry over].
- Credits: AI-generated footage uses credits, which you can buy separately. The price and number of credits each job needs are shown before you confirm it. [Decide how long credits last].
- Billing: subscriptions are paid monthly in advance through our payment provider and renew automatically until you cancel. We'll send you reminders before renewal where the law requires.
- Cancelling: you can cancel at any time in your account settings, with no minimum term. You'll keep your plan until the end of the month you've paid for.
- Your 14-day right to cancel: if you're a consumer, you can cancel a new subscription within 14 days and get a refund. If you start making media during those 14 days, you ask us to start the service straight away, and you'll get a refund minus the value of what you've already used.
- Price changes: we'll tell you in advance of any price change, and you can cancel before it applies.
Nothing in these terms affects your statutory rights as a consumer.
6. Your content and ownership
Your input: you keep ownership of the scripts, text, photos, audio and video you upload. You confirm you have the right to use them. You give us a limited, worldwide, royalty-free licence to store and process them only as needed to make your media and run the service. This licence ends when your content is deleted from our systems.
What we make for you: as between you and us, you own the shorts, voiceovers and other media you create. On paid plans you can use them for personal and commercial projects and publish them wherever you like. Media made on the free plan is for personal, non-commercial use and carries a watermark.
Music and stock voices: music and stock voices we provide are licensed to you for use in the media you make with Video Audio Creator. You can't extract them and use or sell them separately.
AI can produce similar results for different people, so we can't promise your media is unique, or that it is protected by copyright in every country.
7. Voices and consent
- You may only clone your own voice, or the voice of someone who has given you their written permission. We may ask you to prove this.
- You must not use any voice, cloned or stock, to impersonate a real person, put words in someone's mouth without their permission, or make people believe a real person said something they didn't.
- If someone tells us their voice has been cloned without their consent, we'll remove it and may close the account responsible.
8. Acceptable use
You must not use Video Audio Creator to make or share content that:
- is illegal, or sexually exploits or endangers children
- harasses, bullies, threatens or is hateful towards people because of who they are
- is sexually explicit, or shows real people in sexual or intimate situations
- misleads people in a harmful way, such as scams, fake endorsements or reviews, false news, or deceptive election or political content
- infringes anyone's copyright, trade marks or other rights
- is spam or unsolicited advertising
You must also not remove the watermark from free-plan media or the AI labels we add, try to hack, overload or copy the service, or use automated tools to create accounts or media without our permission.
If you break these rules we may remove content, suspend or close your account, and report illegal activity to the police or other authorities.
9. Posting to other platforms
When you post media to YouTube, TikTok, Instagram or anywhere else, you must follow that platform's rules, including any rules about labelling AI-made content. We're not responsible for decisions those platforms make, such as removing a post or deciding whether it can earn money. We don't promise any number of views, followers or sales.
10. Ending your account
You can close your account at any time from your account settings. We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires us to. Where reasonable, we'll tell you first and explain why. Download anything you want to keep before your account closes.
11. Changes to the service
We're always improving Video Audio Creator, so features and the AI services behind them may change. If we remove a paid feature in a way that significantly affects you, we'll tell you and you can cancel. We aim to keep the service available at all times but can't guarantee it will always be uninterrupted or error-free.
12. Our liability to you
If you're a consumer: we're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that wasn't foreseeable.
If you use Video Audio Creator for a business: we're not responsible for loss of profit, revenue, business or opportunity, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.
You're responsible for the media you publish and for checking it, including translations, before you post it.
We don't exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, or for breaching your legal rights as a consumer.
13. Governing law
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of the country where you live.
14. Changes to these terms and how to contact us
We'll update these terms before Video Audio Creator opens and from time to time after that. If a change is important, we'll tell you by email before it takes effect. If you keep using the service after that, you accept the updated terms.
